Welcome to the Flirty40 Community!

By using the Flirty40s app, you agree to be legally bound by our Terms and Conditions ("Terms"). Please take a moment to read them carefully before accessing or using the app, as doing so constitutes your acceptance of these Terms.

You must be 21 years or older when you subscribe to our services for a fixed period (the "Initial Term"). Your subscription will automatically renew for additional terms of the same length at the current rate, unless you cancel before the renewal deadline.

By accessing or using our websites and services, you agree to comply with and be legally bound by these Terms, including any additional terms incorporated by reference. If you do not agree to all of the Terms, you must not use our sites or services.

Privacy Principles

At Flirty40s, protecting your personal information is a top priority. We collect, use, and share your data strictly in accordance with our Privacy Policy. This includes personal details such as your name, email address, phone number, and location data.

Cancellation Rights

To cancel your subscription just delete your account from the Flirty40s account profile menu or please email our support team at support@flirty40s.com. If you purchased your subscription through a third-party provider, you must cancel your subscription directly through that provider, in accordance with their respective terms and conditions.

Special Notices:

California Residents:

You have the right to cancel your subscription or upgrades (including standalone upgrades or those tied to a subscription) without penalty or obligation until midnight of the third business day after the date of purchase.

Colorado Residents:

YOU MAY CANCEL THIS CONTRACT WITHOUT PENALTY OR OBLIGATION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING THE DATE OF PURCHASE, EXCLUDING SUNDAYS AND HOLIDAYS. Your cancellation does not need to follow a specific format—simply send an email stating your intent to cancel to support@flirty40s.com.

Account Requirements

To use the Flirty40s app, you must meet the following conditions:

You must be at least 21 years old or of legal adult age as defined by the laws of your country, state, or region. For users in the U.S., this means you must be 21 years or older and legally permitted to use the app based on your location.
You may not use someone else's account or share your login credentials without their explicit permission.
If you choose to sign in through a third-party service (like Facebook, Google, or Apple), you grant us permission to access and display relevant account information such as profile photos, relationship status, location, and public social connections.
You may delete your account at any time by selecting the "Delete Account" option. Please note that it may take up to 30 days for all your data to be permanently removed from the app. If you attempt to register a new account using the same credentials during that period, your previous account may be reactivated.

Account Monitoring & Enforcement:

We use both moderators and automated systems to monitor user activity and content to ensure compliance with our Terms of Use. We reserve the right to suspend or terminate any account, restrict access, or take legal action without notice or liability if we determine, at our sole discretion, that a user has:

Violated the Terms
Engaged in illegal or inappropriate conduct (online or offline)
Acted inappropriately with other users
Misused or attempted to interfere with the app or its systems

Important: Suspended or terminated accounts are not eligible for refunds for any paid features or services.

Certain parts of the app may only be accessible once you've created and logged into an account.

Payment Terms

When you subscribe to Flirty Plus or Flirty Premium, your payment will be processed through your Google Play or Apple App Store account. Your account will be automatically charged for renewal within 24 hours before the end of your current subscription period.

You can turn off auto-renewal at any time by accessing your subscription settings in the Google Play Store or Apple App Store after completing your purchase.

Subscription Pricing:

Flirty Plus: Starting at $19.99/month, available in 1-month and 12-month plans
Flirty Premium: Starting at $29.99/month, also available in 1-month and 12-month options

All prices are listed in U.S. dollars and may vary depending on your location. Prices are subject to change without prior notice.

Please note:

Subscriptions are non-refundable, and cancellations are not allowed during an active billing period.
If you choose not to subscribe, you can continue to use the app's basic features free of charge.

Automatic Subscription Renewal

If you become a paid subscriber and choose to pay with a credit/debit card or any other method linked to an automatically renewing subscription, your subscription will automatically renew unless canceled before the end of the current term.

Zero Tolerance for Abusive Content

Flirty40s maintains a strict zero-tolerance policy for abusive, harmful, or inappropriate content. We are committed to fostering a safe, respectful, and friendly environment for all members. Any content that violates these standards may result in the offending user being blocked, suspended, or permanently removed from the platform.

Prohibited Content Includes (but is not limited to):

Defamatory, obscene, aggressive, or hateful material
Racist, abusive, or discriminatory comments
Content that promotes or condones illegal activity
Commercial content, spam, or content containing viruses
Impersonation of others or unauthorized use of someone else's identity
Content that infringes on another person's rights or privacy
Material that is harmful to minors
Posting another person's personal information without consent

User Responsibility:

Members are responsible for ensuring that their posts and interactions follow the community guidelines. Conversations should be conducted in a respectful and friendly manner. Sharing sensitive personal information—such as your address, financial details, or anything that may compromise your safety—is strongly discouraged.

If you encounter abusive behavior, you are encouraged to block the offending user and report abuse by emailing us at support@flirty40s.com.

Content Ownership and Usage Rights

By posting content on Flirty40s, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, adapt, translate, distribute, and publicly display your content. You represent and warrant that you have the legal rights to share any content you post.

You remain the owner of the content you post, and are solely responsible for complying with all applicable copyright laws.
If you believe your copyrighted work has been posted without your permission, you may take appropriate legal action against the uploader.
However, by using the platform, you agree to indemnify Flirty40s against any legal claims arising from your content, including copyright infringement.

Additional Service Terms

Our services include websites, mobile applications, social media integrations, downloadable products, and any related features or content (collectively, the "Services"). We may add, modify, or discontinue any part of the Services at our discretion. This Agreement will apply to all such changes unless otherwise stated.

All users of our Services—whether registered or not—are considered "Users." If you register for an account, you become a "Member."

We reserve the right to update this Agreement and other related policies at any time. Any updates will be announced by posting a revised version of the Agreement on our site along with an updated "Last Revised" date.

Arbitration Agreement

Binding Arbitration Clause

Dispute Resolution by Binding Arbitration:

Any dispute, claim, or controversy arising out of or relating to this Agreement, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through final and binding arbitration, rather than in court. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, except as modified by this Agreement.

The arbitration will be conducted by a single, neutral arbitrator and take place in the county where you reside or another mutually agreed location. Judgment on the arbitrator's award may be entered in any court having jurisdiction thereof.

Class Action Waiver:

You and the Company agree that any arbitration will be conducted only on an individual basis and not in a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

Waiver of Jury Trial:

By agreeing to arbitration, both parties waive the right to a jury trial or to participate in a class action.

Payment Policies

Flirty40s offers in-app purchases and subscription options through the App Store, Google Play, and other payment methods such as credit cards, debit cards, or PayPal. By making a purchase, you authorize Flirty40s to charge your chosen payment method.

Subscriptions, including those for one week, one month, or three months, may automatically renew at the current rate unless canceled before the end of the subscription period. Some free trials may convert to paid subscriptions if not canceled in time. Subscription cancellations can be managed directly through Flirty40s or the app store where the purchase was made.

Please note: Most payments are non-refundable. However, certain jurisdictions may allow refunds within a specific timeframe. Users should contact our customer support team for assistance with refund requests. Sales taxes may apply where required by law.

Virtual Items, Notifications & Location-Based Features

Virtual Items

Flirty40s may offer virtual items, such as limited-use features or in-app enhancements. These are considered revocable, non-transferable licenses and do not represent ownership of any kind. The balance shown in your account reflects your access—not a monetary value. We reserve the right to update, restrict, or remove virtual items at any time. All purchases of virtual items are final and non-refundable.

Notifications

You may also receive push notifications, emails, text messages, and other communications about Flirty40s features, promotions, and offers. You can manage notification preferences in your mobile device settings.

Location-Based Features

For features that rely on your location, such as nearby matches or location-based services, you must enable location sharing. Please refer to the Privacy Policy for more details on how your information is collected, used, and stored.
